General terms and conditions of sale

Read below the general terms and conditions of the second-hand webshop TheLocker Monnikenhofstraat 175 2040 Antwerpen, BE 0598 829 597.

The general terms and conditions are applicable to the purchase of articles via the webshop of TheLocker.be. By purchasing an article through our webshop and having paid, you, the buyer, automatically and irrevocably agree to our general sales conditions. In other words, by placing your order, you agree to the general terms and conditions including the sales, delivery and payment terms.

Sales agreement and transfer of ownership

The purchase agreement is concluded between 2 parties namely the buyer

(adult and legal) and the seller “TheLocker.be”. This final purchase is concluded at the moment that the buyer has received the confirmation. TheLocker.be remains owner of the goods until the moment that the purchase amount appears on our account. Our payment options can be found on the payment page of our webshop.

Order

As we sell second hand items, there is only one piece in stock. Since the web shop only offers a limited selection of our articles and we also sell the articles in our physical sales outlet, there is a chance that the article you purchased is no longer for sale. The seller pays the received amount, after receipt into his account by bank transfer with clear mention of the article number. The seller is not liable for this. The buyer is aware of this and waives any form of compensation.

Payment

YOU CAN PAY EASILY AND SAFE

By bank transfer, online (bancontact, credit card), offline cash or with a voucher.

Bank transfer: You will receive our bank details in an email confirming your order. As soon as we receive your payment, we will ship your order or bring it to you personally within a radius of 5km. You may also make a print screen of the bank transfer, then the delivery is even faster. If the payment is not made after 10 days, your order will be cancelled.

Online: You will be redirected to the website of Stripe, where you can safely pay with bancontact or credit card. As soon as we have received your payment, we will ship your order or bring it to you personally (5km).

Vouchers: Vouchers are currently only available in our physical store at Monnikenhofstraat 175, 2040 Antwerp.

Cash: Only in our physical store at Monnikenhofstraat 175 2040 Antwerpen.

Product information

The seller does his utmost to display the products as faithfully as possible. The photos are taken carefully. Nevertheless, the buyer must be aware of possible color differences and that not all details can be seen. These are second hand items and each has its traces of use. Each item has as detailed a description as possible. The description of the condition of the item is subjective and may differ from someone else’s opinion/findings. Nevertheless, it is not possible for second hand to always give 100% detail of all information. That’s why you can always contact us to come and see the article in our store or to try it on. Especially with clothing, it is very important that you take into account the size charts associated with certain brands. Also when buying shoes you should take into account the lasts of the different brands.

We do not sell anything without a label.

Pricing

The selling price of our items is based on the new price of the goods, quality, condition, scarcity, the demand for certain items, … New Price does not take into account promotions or purchases of items in stock sales or sales season.

On certain items, a discount can only be granted temporarily by the seller. The seller cannot be held liable for a certain price setting. The prices of the products are indicated in euros with all taxes included, except for the participation in shipping costs. We reserve the right to change our prices at any time, but the products will be invoiced based on the rates in effect at the time of order confirmation.

Shipping Costs and Delivery Times.

Shipping times via Delivery Service (i.e., not delivery times) are indicative only and not binding. We make every effort to respect the indicated delivery time. If the ordered goods are not delivered within 30 days, the agreement may be considered to be dissolved. In that case we will refund any payment received within 30 days.

The shipping costs are entirely at your expense unless otherwise agreed. We are not liable for loss, incorrect address, theft or damage during shipment of products ordered by you. We pack the products in such a way that the risk of damage is as small as possible.

You can always opt to pick up the item yourself in our physical store. Please mention this clearly in your order.

RENUNCIATION RIGHT

The Belgian law on trade practices and information and consumer protection of April 6, 2010, allows the (consumer) buyer within 14 working days of receiving the product to inform us that you renounce the sale.

If you, as a buyer, want to renounce the sale you can do so within 14 working days following the delivery of the order. The products must then be returned to the Vendor within the same period in their original, undamaged and original packaging together with (a copy of) the invoice/delivery note. Incomplete, damaged, used or soiled products will not be taken back. The red strip must not have been removed when the article was returned.

Within 30 days of acceptance of the return, we will refund any monies paid, excluding the direct cost of delivery. Products with a discount are not refunded, but exchanged for a voucher in the value of the purchased product. This voucher is valid for 1 year. The shipping costs will be borne by TheLocker.be if they would have sent a faulty product.

FAULTY

We make every effort to ensure that the information provided is complete, correct, accurate and updated. Despite these efforts, errors may occur in the information provided. If the information provided should contain errors or if certain information on or via the site should be unclear, we will try to rectify this as soon as possible. However, we cannot be held liable for direct or indirect damages resulting from the use of the information on TheLocker.be. Should you find any inaccuracies on our website and/or in the store, we ask you to report this to us in good faith. We prefer to try to solve everything amicably so that both parties are satisfied.

OVERVIEW

We will do our utmost to fulfill our obligations under the agreement. However, we cannot be held responsible for delays or omissions if they are due to circumstances beyond our control. In the event of a delay, we will fulfil our obligations as soon as possible.

APPLICABLE LAW

The sale to which this agreement relates is subject to Belgian law. The Belgian courts of Antwerp have exclusive jurisdiction.
